Bu belge, Nova Yüzme Kulübü mobil uygulamasının gizlilik politikasıdır. Nova Yüzme Kulübü uygulaması, Kaira Digital Arts S.R.L (geliştirici) tarafından, çok sayıda spor kulübüne hizmet veren SporMobil yazılım altyapısı üzerinde işletilmektedir. Aşağıdaki esaslar, bu uygulama üzerinden işlenen kişisel verileriniz için geçerlidir.
İşbu metin, Kaira Digital Arts S.R.L ("Şirket", "biz") tarafından işletilen Nova Yüzme Kulübü uygulaması (SporMobil altyapısı üzerinde; birlikte "Uygulama", "Platform") kapsamında, 6698 sayılı Kişisel Verilerin Korunması Kanunu ("KVKK") uyarınca kişisel verilerinizin işlenmesine ilişkin sizi bilgilendirmek ve gizlilik esaslarımızı açıklamak amacıyla hazırlanmıştır. Uygulama, kulüp yönetim hizmeti sunan bir yazılımdır; verileriniz, üyesi olduğunuz kulüp ile Şirket arasındaki rol paylaşımı çerçevesinde işlenir (bkz. Bölüm 1). Uygulamayı kullanarak bu metinde açıklanan esasları kabul etmiş olursunuz.
Kaira Digital Arts S.R.L, Romanya'da kurulu bir şirket olup yalnızca SporMobil platformunu (yazılım altyapısını) işletir. Şirket, bu platform üzerinden işlenen üye verilerini kendi amaçları için KULLANMAZ; bu verileri satmaz, pazarlama yapmaz, ticari analiz/profilleme amacıyla işlemez. Şirketin rolü, kulüplerin hizmeti kullanabilmesi için gerekli teknik altyapıyı sağlamakla sınırlıdır.
Üye verileri (sporcu, veli, antrenör kayıtları; ölçüm, aidat, yoklama, mesaj vb.) bakımından, bu verileri giren, kullanan ve yöneten ilgili KULÜP veri sorumlusu konumundadır. Şirket bu veriler bakımından, kulübün talimatları doğrultusunda hareket eden veri işleyen konumundadır. Verilerin hangi amaçla kullanılacağı ve ne kadar saklanacağı ilgili kulüp tarafından belirlenir.
Veriler, teknik olarak Şirketin yönettiği Firebase / Google Cloud altyapısında (Şirketin hesabı üzerinde) barındırılır. Şirket bu verilere yalnızca platformun işletilmesi, bakımı ve güvenliği için gerekli olan asgari ölçüde ve yetkili erişim çerçevesinde erişebilir; verileri kendi amaçları için işlemez.

Platform üzerinde, kullanıcı rolüne (kulüp yöneticisi, antrenör, veli, sporcu vb.) göre aşağıdaki veri kategorileri işlenebilir:
Kişisel verileriniz; üyelik ve kulüp yönetim hizmetinin sunulması, yoklama-antrenman-performans takibi, veli ile iletişim, aidat ve finans yönetimi, servis/ulaşım organizasyonu, duyuru ve bildirim gönderimi, güvenlik ve yetkilendirme ile yasal yükümlülüklerin yerine getirilmesi amaçlarıyla işlenir.
Bu amaçlar üyesi olduğunuz kulüp tarafından belirlenir; Şirket yalnızca bu işlemlerin gerçekleştirilebilmesi için teknik altyapıyı sağlar. Şirket, verilerinizi kendi ticari amaçları, üçüncü kişilere satış, reklam/pazarlama veya profilleme amacıyla işlemez.
Verileriniz KVKK m.5 ve m.6 kapsamında şu hukuki sebeplere dayanılarak işlenir: bir sözleşmenin kurulması veya ifasıyla doğrudan ilgili olması, hukuki yükümlülüğün yerine getirilmesi, bir hakkın tesisi/kullanılması/korunması ve veri sorumlusunun meşru menfaati. Sağlık verileri başta olmak üzere özel nitelikli kişisel veriler yalnızca açık rızanız bulunması halinde işlenir.
Platform, altyapı hizmetleri için Google LLC tarafından sağlanan Firebase / Google Cloud servislerini (kimlik doğrulama, veritabanı, dosya depolama, bildirim, barındırma) kullanır ve veriler Şirketin bu sağlayıcılardaki hesabı üzerinde barındırılır. Bu kapsamda verileriniz, hizmetin sağlanabilmesi için yurt dışındaki sunucularda işlenebilir ve saklanabilir.
Ödeme ve abonelik işlemleri için Stripe gibi yurt dışında yerleşik ödeme hizmeti sağlayıcıları kullanılabilir; bu durumda ödeme işleminin gerçekleştirilmesi için gerekli veriler ilgili sağlayıcıya aktarılabilir.
Verileriniz; bağlı olduğunuz kulübün yetkili kullanıcıları, yasal olarak yetkili kamu kurum ve kuruluşları ile hizmetin ifası için çalışılan altyapı/ödeme tedarikçileri dışında üçüncü kişilerle paylaşılmaz; pazarlama amacıyla satılmaz. Yurt dışı aktarımlar KVKK m.9 çerçevesinde ve gerekli güvenlik tedbirleri alınarak gerçekleştirilir.
Kişisel verileriniz; uygulamaya kayıt ve giriş, kulüp yöneticisi/antrenör tarafından yapılan kayıt işlemleri, ön kayıt ve kayıt formları, uygulamadaki tanıtım sayfalarından gönderdiğiniz üyelik, görüşme, kulübe katılma ve kulüp bilgi talepleri, uygulama içi etkileşimleriniz ve yüklediğiniz içerikler aracılığıyla elektronik ortamda toplanır. Bir kulübün tanıtım sayfasından gönderilen talepler yalnızca o kulübün yöneticilerine iletilir. SporMobil açılış ekranından gönderilen talepler Şirket tarafından değerlendirilir; kulübe katılma talepleri, verdiğiniz onay doğrultusunda yalnızca uygun bulunan kulübe iletilir. Bu talepler, değerlendirilmesi ve sizinle iletişime geçilmesi amacıyla açık rızanıza dayanılarak işlenir ve talep sonuçlandırıldıktan sonra silinebilir.
Kişisel verileriniz, işlenme amaçlarının gerektirdiği süre boyunca ve aşağıdaki esaslara göre saklanır:
Saklama süresinin belirlenmesinde; ilgili mevzuatta öngörülen süreler, verinin işlenme amacının gerektirdiği süre ve kulübün (veri sorumlusunun) saklama tercihi dikkate alınır. Mevzuatın belirli kayıtlar için öngördüğü zorunlu saklama süreleri saklıdır. Şirket, kulübün talimatı ve platformun işletilmesi için gerekli olan asgari sürenin ötesinde veri saklamaz.
Hesabınızın ve kişisel verilerinizin silinmesini talep etme hakkınız vardır. Talebinizi aşağıdaki yöntemlerle iletebilirsiniz:
1) Çevrimiçi silme talep formu (önerilen): Herhangi bir giriş yapmanıza gerek olmadan, aşağıdaki sayfadan hesap/veri silme talebinizi gönderebilirsiniz:

Formda ad-soyad, kulüp adı ve iletişim bilgilerinizi girmeniz yeterlidir. Talebiniz, verilerinizin sorumlusu olan kulübünüze ve platform yöneticisine iletilir.
2) Kulübünüze başvuru: Verilerinizin sorumlusu üyesi olduğunuz kulüp olduğundan, silme talebinizi doğrudan kulüp yöneticinize de iletebilirsiniz.
3) E-posta: Kulübünüze ulaşamıyorsanız veya platforma ilişkin sorularınız için info@kairadigitalarts.com adresine yazabilirsiniz.
Silme talebi onaylandığında, kişisel verileriniz platformdan (kimlik doğrulama kayıtları ve veritabanı kayıtları dahil) kalıcı olarak silinir. Mevzuatın zorunlu kıldığı saklama süreleri (örneğin finansal kayıtlar) saklı kalır; bu süreler dolduğunda ilgili veriler de silinir. Talepleriniz, KVKK ve ilgili mevzuatta öngörülen süreler içinde sonuçlandırılır.
Platform, spor kulüpleri için tasarlanmış olup sporcuların bir kısmı reşit olmayan çocuklar olabilir. Çocuklara ait kişisel veriler, veli/yasal temsilcinin bilgisi ve uygun hallerde açık rızası kapsamında, yalnızca kulüp hizmetinin sunulması amacıyla işlenir. Veliler, çocuklarına ait verilere ilişkin KVKK m.11 haklarını (silme talebi dahil) çocukları adına kullanabilir.
Şirket, kişisel verilerin hukuka aykırı erişime, kayba ve ifşaya karşı korunması için rol bazlı erişim yetkilendirmesi, taşıma sırasında şifreleme, erişim kayıtları ve düzenli güvenlik denetimleri dahil idari ve teknik tedbirleri uygular. Verilere erişim, yalnızca yetkilendirilmiş kullanıcı ve rollerle sınırlıdır.
KVKK m.11 uyarınca; kişisel verinizin işlenip işlenmediğini öğrenme, işlenmişse buna ilişkin bilgi talep etme, işlenme amacını ve amaca uygun kullanılıp kullanılmadığını öğrenme, yurt içinde/dışında aktarıldığı üçüncü kişileri bilme, eksik/yanlış işlenmişse düzeltilmesini, ilgili mevzuat çerçevesinde silinmesini/yok edilmesini isteme, bu işlemlerin aktarıldığı üçüncü kişilere bildirilmesini isteme, münhasıran otomatik analizle aleyhinize bir sonucun ortaya çıkmasına itiraz etme ve kanuna aykırı işleme nedeniyle zararın giderilmesini talep etme haklarına sahipsiniz.
Üye verilerinize ilişkin (düzeltme, silme, bilgi alma vb.) talepleriniz, bu verilerin sorumlusu olan kulübünüzce karşılanır; bu nedenle taleplerinizi öncelikle üyesi olduğunuz kulübe iletmeniz gerekir. Şirket, kulübün bu talepleri yerine getirmesi için gerekli teknik desteği sağlar. Hesap/veri silme talepleri için ayrıca spormobil.com/delete-user sayfasını kullanabilirsiniz.
Platformun işleyişine ilişkin sorularınızı veya kulübünüze ulaşamadığınız durumları info@kairadigitalarts.com adresine iletebilirsiniz.
Platform; oturumun sürdürülmesi, tercihlerinizin hatırlanması ve temel işlevlerin sağlanması için tarayıcı yerel depolaması ve benzeri teknolojileri kullanabilir. Bu teknolojiler hizmetin çalışması için gereklidir.
İlk girişte bu metni okuyup onayladığınızda, açık rıza gerektiren işlemler bakımından rızanız kayıt altına alınır. Metnin güncellenmesi halinde sürüm numarası değişir ve gerektiğinde yeniden onayınız istenir. Güncel sürüm her zaman bu sayfada yayımlanır.

This is the privacy policy of the Nova Yüzme Kulübü mobile app. The Nova Yüzme Kulübü app is operated by Kaira Digital Arts S.R.L (the developer) on the SporMobil software platform, which serves many sports clubs. The practices below apply to the personal data processed through this app.
This Privacy Policy explains how Kaira Digital Arts S.R.L ("the Company", "we") processes personal data within the Nova Yüzme Kulübü application (running on the SporMobil platform; together "the App", "the Platform"), and describes our privacy practices, including data retention and data deletion. The app is software providing club-management services; your data is processed under a shared-responsibility model between the club you belong to and the Company (see Section 1). By using the App you accept the practices described here.
Kaira Digital Arts S.R.L is a company established in Romania that operates only the SporMobil platform (the software infrastructure). The Company does NOT use member data processed through the platform for its own purposes; it does not sell this data, does not market to you, and does not process it for commercial analysis or profiling. The Company's role is limited to providing the technical infrastructure so that clubs can use the service.
With respect to member data (athlete, parent and coach records; measurements, dues, attendance, messages, etc.), the relevant CLUB that enters, uses and manages this data is the data controller. The Company acts as a data processor, acting on the club's instructions. The purposes for which data is used and how long it is retained are determined by the relevant club.
Data is technically hosted on Firebase / Google Cloud infrastructure managed by the Company (on the Company's account). The Company accesses this data only to the minimum extent necessary to operate, maintain and secure the platform, under authorized access; it does not process the data for its own purposes.

Depending on your role (club manager, coach, parent, athlete, etc.), the following categories of data may be processed:
Your personal data is processed to provide the membership and club-management service, attendance/training/performance tracking, communication with parents, dues and finance management, transport organization, announcements and notifications, security and authorization, and to fulfill legal obligations.
These purposes are determined by the club you belong to; the Company only provides the technical infrastructure to make these operations possible. The Company does not process your data for its own commercial purposes, for sale to third parties, for advertising/marketing, or for profiling.
Your data is processed on the following legal bases: the establishment or performance of a contract, compliance with a legal obligation, the establishment/exercise/protection of a right, and the legitimate interests of the data controller. Special categories of data, in particular health data, are processed only where you have given explicit consent.
The Platform uses Firebase / Google Cloud services provided by Google LLC (authentication, database, file storage, notifications, hosting) for infrastructure, and data is hosted on the Company's account with these providers. Accordingly, your data may be processed and stored on servers located abroad in order to provide the service.
For payment and subscription transactions, payment service providers established abroad (such as Stripe) may be used; in this case the data necessary to carry out the payment may be transferred to the relevant provider.
Your data is not shared with third parties other than authorized users of the club you belong to, legally authorized public authorities, and the infrastructure/payment suppliers used to deliver the service; it is not sold for marketing purposes. International transfers are carried out with appropriate safeguards.
Your personal data is collected electronically through registration and login, registration performed by the club manager/coach, pre-registration and registration forms, membership, meeting, club-joining and club information requests you send from the public pages in the app, your in-app interactions, and the content you upload. Requests sent from a club's page are shared only with that club's managers. Requests sent from the SporMobil welcome screen are handled by the Company, and club-joining requests are passed on, with your consent, only to the club found suitable. These requests are processed with your explicit consent to handle the request and contact you, and may be deleted once the request is resolved.
Your personal data is retained for as long as required by the purposes of processing and in line with the following principles:
Retention periods are determined by the periods prescribed by applicable law, the period required by the purpose of processing, and the retention preference of the club (the data controller). Mandatory statutory retention periods for certain records are reserved. The Company does not retain data beyond the minimum period needed to operate the platform and as instructed by the club.
You have the right to request deletion of your account and personal data. You can submit your request using any of the following methods:
1) Online deletion request form (recommended): You can submit an account/data deletion request from the page below, without needing to log in:

Simply enter your full name, club name and contact details in the form. Your request is forwarded to your club (the data controller) and to the platform administrator.
2) Contact your club: Because the data controller is the club you belong to, you can also send your deletion request directly to your club manager.
3) Email: If you cannot reach your club, or for platform-related questions, you can write to info@kairadigitalarts.com.
Once a deletion request is approved, your personal data is permanently deleted from the platform (including authentication records and database records). Statutory retention periods required by law (for example, financial records) are reserved; such data is deleted once those periods expire. Requests are handled within the periods prescribed by applicable law.
The Platform is designed for sports clubs, and some athletes may be minors. Personal data of children is processed with the knowledge of, and where appropriate the explicit consent of, the parent/legal guardian, solely to provide the club service. Parents may exercise the rights (including deletion requests) relating to their children's data on their behalf.
The Company applies administrative and technical measures to protect personal data against unlawful access, loss and disclosure, including role-based access authorization, encryption in transit, access logs and regular security reviews. Access to data is limited to authorized users and roles only.
You have the right to: learn whether your personal data is being processed and request information about it; learn the purpose of processing and whether it is used accordingly; know the third parties to whom it is transferred domestically or abroad; request correction if it is incomplete/incorrect; request its deletion/destruction under applicable law; request that these actions be notified to third parties to whom the data was transferred; object to results arising solely from automated analysis to your detriment; and request compensation for damage arising from unlawful processing.
Requests regarding member data (correction, deletion, information, etc.) are handled by your club, which is the controller of that data; therefore you should first submit your requests to the club you belong to. The Company provides the technical support needed for the club to fulfill these requests. For account/data deletion requests you may also use spormobil.com/delete-user.

The Platform may use browser local storage and similar technologies to maintain your session, remember your preferences and provide core functionality. These technologies are necessary for the service to work.
When you read and accept this notice on first login, your consent for operations requiring explicit consent is recorded. If this notice is updated, the version number changes and, where necessary, your consent is requested again. The current version is always published on this page.
